Divorce Options in Simple Steps

STEP 1: Decide with your Spouse if the two of you will collaborate or litigate:

  • If the two of you are committed to collaborating, then go to the next step.
  • If one or both of you prefer to litigate, then you need to meet with lawyers. A contested divorce typically cost in the tens of thousands and takes many months.

STEP 2: Together decide to complete the Separation Agreement through the app or a mediator:

  • If the two of you are interested in the Divorce Digitally app, go to the next step.
  • If you prefer to mediate your Separation Agreement  negotiation, click here to have a complimentary consultation with a licensed mediator: www.maddeny.com. A mediated divorce typically costs around $3,000 and is completed within a few weeks.

STEP 3: Understand how the Divorce Digitally app will produce the Separation Agreement:

  • The Divorce Digitally app will guide you through a multi-step process to compile all of the information required to be addressed by the courts.
  • The app will guide you through the two major parts: Equity Distribution AND the Child Custody, Visitation and Support.
  • The Equity Distribution part includes Assets and Liabilities, which will require you and your spouse to list. This includes marital as well as personal and individual assets and liabilities as required by legal code.
  • The Child(ren) part will include their schedule as far as parenting time is concerned, which is referred to as “Visitation”. In this part Custody is also presented. Finally, you will be provided with a link to run the Child Support calculating.
  • Spousal Support is presented at which time, the two of you can make the appropreate decisions regarding how much and for how long if applicable.
  • Other Financial issues will be presented and addressed if applicable to your situation.
  • Finally, the court expects a complete Separation Agreement that includes and clearly addresses all of the above in a truthful and transparent fashion.
  • The court might require you and your spouse to appear before a judge if the Separation Agreement is lacking, or raises flags, so make sure to be completely open and truthful in your filling.

STEP 4: Upon completing the Separation Agreement here, hire a lawyer to file your Divorce.

  • Divorce Digitally is an app, therefore it is not authorized to represent you legally in court – you will need a lawyer to file for Divorce on your behalf.
  • Divorce Digitally is compiling a list of lawyers who will review your Separation Agreement draft and make any needed changes in addition to filing the divorce petition for you.
